- Only individual customers of Oversea-Chinese Banking Corporation Limited (“OCBC Bank”) who successfully log into Secured Mobile banking Services for the 1st time, are eligible under the Promotion (each, an “Eligible Customer”). The Promotion Period will be from 15 January 2008 to 31 December 2008 (both dates inclusive).
- Under the Promotion, an Eligible Customer will accumulate 1 chance in that quarter that he/she logs into Secured Mobile Banking services for the 1st time.
- The Quarterly Draws will be conducted at Noon at OCBC Centre Branch, Banking Hall, 65, Chulia Street, OCBC Centre, on the following dates:
- draw date: 9 April 2008 , Noon (qualifying period: 15th Jan to 31st Mar 2008)
- draw date: 9 Jul 2008 , Noon (qualifying period: 1st Apr to 30th Jun 2008)
- draw date: 9 Oct 2008, Noon (qualifying period: 1st Jul to 30th Sep 2008)
- draw date: 9 Jan 2009, Noon (qualifying period: 1st Oct to 31st Dec 2008)
- Employees of OCBC Bank shall not be eligible for the Draw.
- Winners will be selected at random by OCBC Bank (by manual or computerized means as OCBC Bank may determine) in the presence of OCBC Bank's auditors. OCBC Bank reserves the right to draw reserve Winners to replace any Winner subsequently found to be disqualified. Winners of the Quarterly Prizes will be contacted by telephone within 5 working days of the respective draw date, and notification letters with instructions on how to redeem the prizes will be mailed to the Winners within 10 working days of the respective draw date.
- Each prize winner shall accept the gift on an “as is” basis. OCBC Bank gives no representation or warranty whatsoever as to the quality, merchantability or fitness for purpose or any other implied terms or conditions with respect to any gift. Notwithstanding anything herein, OCBC Bank shall not at any time be responsible or held liable for any defect or malfunction in any prize, and/or for any loss, injury, damage or harm suffered or incurred by or in connection with the use of any prize by any person. All prizes are neither transferable nor exchangeable for cash, credits, or otherwise. All prizes are also subject to the terms and conditions accompanying them (if any).
- This offer is not valid with other OCBC Bank promotions that may be running concurrently.
- If OCBC Bank subsequently determines that a person is in fact not eligible for any prize, for any reason whatsoever, OCBC Bank may at its discretion reclaim the prize and award or dispose of it in such manner and to such person/persons as OCBC Bank deems fit in its sole discretion.
- No person shall be entitled to any payment or compensation from OCBC Bank should any prize be forfeited or reclaimed. Without prejudice to the generality of the foregoing, OCBC Bank reserves the right to disqualify any person from the Promotion if in the opinion of OCBC Bank there has been any fraud or breach of the Promotion terms and conditions.
- OCBC Bank reserves the right to terminate the Promotion at any time without notice. OCBC Bank shall not be liable to any person for any loss or damage arising in connection with the Promotion, including without limitation, any error in computing any chances, any breakdown or malfunctions in any computer system or equipment. Without prejudice to the generality of the foregoing, OCBC Bank assumes no responsibility for lost, late, misdirected, damaged, incomplete, illegible and/or postage-due mail.
- The decision of OCBC Bank on all matters relating to the Promotion shall be final, binding and conclusive on all participants, including, without limitation, any decision on the eligibility of any person or to cancel or suspend the Promotion. Subject to and without prejudice to the generality of the foregoing, OCBC Bank's record(s) of the entries and/or the Promotion shall be final, binding and conclusive for all purposes and in any legal proceedings. No correspondence will be entertained.
- In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Promotion, these terms and conditions shall prevail.
- OCBC Bank may at any time at its absolute discretion, without notice or assigning any reason therefore, delete, vary, supplement, amend or modify any one or more of these terms and conditions in such manner as OCBC Bank shall think fit, including without limitation, the eligibility of any customer, the bases and methods of identification of Eligible Customers and any dates in connection with the Promotion. OCBC Bank shall not, to the extent permitted by law, be liable to for any claims, costs, expenses, loss or damage suffered by any person as a result of the aforementioned matters.
- OCBC Bank shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of any prize. Notwithstanding anything herein, OCBC Bank shall not at any time be responsible or held liable for any defect or malfunction in any prize, and/or for any loss, injury, damage or harm suffered or incurred by or in connection with the use of any prize by any person.
- All customer contact details provided pursuant to this Promotion will become the property of OCBC Bank, and may be used by OCBC Bank in its sole discretion for future marketing related programs.
- These terms and conditions shall be governed by the laws of Singapore and the participants in the Promotion irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore. A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions.
